The California Supreme Court unanimously rejected the industry's claim Thursday that the statute of limitations for smokers filing claims for physical injury starts as soon as they discover they're addicted to cigarettes -- a rationale based on a previous 9th U.S. Circuit Court of Appeals decision from 2002 that has road-blocked similar cases and, one plaintiffs attorney argued, probably deterred others from even filing at all.
In the latest ruling, the court essentially found that the state's two-year statute of limitations begins when the smoker is diagnosed with a disease caused by the cigarettes.
"The California Supreme Court has resurrected stalled tobacco cases in the 9th Circuit," said Michael Baum, who represented one plaintiff in the trial court.
Deciding a case referred to them by a 9th Circuit panel, the justices unanimously ruled that Leslie Grisham -- who alleges she got hooked on cigarettes in the early 1960s and was recently diagnosed with severe periodontal disease and emphysema -- and fellow plaintiff and emphysema sufferer Maria Cannata could go forward with their lawsuits against the tobacco industry.
